For marriage-based immigration petitions, Form I-130, or Petition for Alien Relative, is filed by a U.S. citizen or lawful permanent resident to establish a qualifying marital relationship with their non-citizen spouse and petition for their eligibility to legalize. Approval of this form is the first step in the green card through marriage process, demonstrating the relationship but not conferring immigration status on its own. In certain cases, Form I-130 can be filed along with Form I-485.
